DIVORCE AND SEPARATION

"Anyone who feels trapped in a marriage can find many marriage counselors, each with their own opinions, to tell them what's best. But when it comes to divorce, it takes more than an opinion to discover the right thing to do — it takes wisdom",  Focus on the family.

Having said that, The most common ground for receiving a divorce is where the husband and wife are “incompatible.” When obtaining a divorce due to incompatibility it is important to remember that you or your spouse have a right to get a divorce even if the other party does not want one.

You can only get divorced in Nevada if one of the parties is a resident of the state of Nevada for at least six weeks prior to the filing of the Complaint for Divorce. The most common way to prove residency is by providing a witness who lives in Nevada to testify that you have lived in Nevada for at least six weeks prior to your filing for Divorce

CUSTODY

No divorce or separation is without stress. When kids under the age of 18 years are involved, it’s quite challenging to determine who will live with children, spend time with them, have the privilege and responsibility of making decisions regarding their health, their religious upbringing and education.

Our custody attorney will guide you through this tumultuous time and help create a solution for stable environment for your children and reduce the stress.

In most cases, child support is fairly-simple to determine and can be resolved without going to court. Children are precious, and every decision that we make is to serve the best interests of them by determining the most appropriate custody arrangement. We will look for innovative resolutions to protect your children’s best interests

Nevada court systems often give parents who are divorcing joint legal custody. Sole legal custody is rare in Nevada, and is only awarded if one parent has no involvement with the child, is a felon, is mentally impaired, or does not want any legal rights. We will explain the difference between joint physical custody and one parent having primary physical custody.

We will put together a thorough creative solution for the custody of your children using litigation or custody mediation

Our interest is protecting your interest (safeguarding your children).

CHILD SUPPORT AND ALIMONY

Divorce can be a very complex matter, especially when under age kids are involved. Child custody may lead to Child Support and Alimony.

Child support is money paid to the custodial parent to pay for reasonable needs of the child or children for health, education and other maintenance. Sometimes, additional support may be requested to pay for extra expenses incorporated into separation agreements / consent order. The Punishment Act of 1998 enforces legal means to get the default parent to pay for child support. Prison terms and fines can be levied.

Alimony is money paid to when one spouse has given up earning potential in order to raise the children, the other spouse needs to compensate him or her. It’s also to help a spouse continue the standard of living they had during marriage. Alimony is not meant to help with childcare expenses, extracurricular activities, or other expenses related to children. Nevada has three types of alimony; temporary, rehabilitative, and permanent. There are many factors that go in to calculate spousal support. In order to understand your options, you should discuss the possibility of paying or receiving alimony with our experienced divorce attorney who will review your case at no initial charge to you.
